There is no single structure. NIB works with three paths, chosen according to the property, the seller and the client's profile: rent-to-buy (art. 23 D.L. 133/2014), with a share of the rent allocated to the final price and the right recorded; sale with the price paid in instalments directly to the seller, without any third-party lender; co-purchase in joint ownership with progressive buy-out of the other co-owner's share, inspired by diminishing Musharaka (Musharaka mutanaqisa). Murabaha is not the standard structure: it involves a double transfer of ownership and Italian law provides no relief, so transfer taxes would be paid twice.
In a correct Murabaha, yes: ownership and risk must actually pass through the financier, otherwise the operation is an interest-bearing loan in disguise. That is exactly why Murabaha is costly in Italy — the double transfer of ownership means registration, mortgage and cadastral taxes are paid twice, and there is no dedicated relief as in the United Kingdom. For that reason we do not propose it as the standard solution. If for a client it were an indispensable condition, we assess it as a specific case, but only after a written tax opinion on the double tax burden.
Yes. The overall price and the payment schedule are set in the deed; they are not linked to any interest rate or financial index and they do not increase with the passage of time. The only element that in Italian practice may vary is a possible ISTAT adjustment of the enjoyment component in a rent-to-buy: it can be excluded by contract and, at the client's request, we exclude it when drafting.
The items are: the Banks4All fee for structuring, checks and assistance through to completion; notary fees and deed expenses; transfer taxes (registration, mortgage, cadastral), at different rates depending on first-home eligibility and the nature of the seller; land-registry and cadastral searches and inspections, with any survey or technical check; any estate-agency commission, if the property comes from an agency; any translations or an interpreter at the deed. No hidden commission and no cost that appears later. Amounts are set out in a written, named quote for the concrete property: on a hypothetical property any figure would be invented.
Yes, without reservation. The client receives the complete draft of the documentation before signing and before paying any sum, and is expressly invited to have it reviewed by a lawyer of their choice and by the notary, who is freely chosen by the client. If a structure does not stand up to the reading of the client's adviser, it is right that this emerges at that moment.
No. NIB Home does not currently hold a certification issued by a Sharia board or by a body specialised in Islamic finance, and we do not hold any fatwa. What we can document is different: a design founded on the principles of Islamic finance — no interest, no speculation, real ownership of the asset, sharing of risk — drawn from comparative study of services offered abroad, and their translation into valid and enforceable instruments under Italian law, checked by legal and notarial professionals. Calling "certified" what is not would be incorrect. We are fully available to submit the contractual drafts to a scholar or a body trusted by the client and to adapt what Italian law allows to be adapted.
